Terms of Service

These Terms govern your use of NiceYard and related services (the "Service"), including receiving receipts by SMS, storing payment methods, and charging customers for completed jobs. By using NiceYard, you agree to these Terms.

Who these Terms apply to

NiceYard supports two kinds of users:

  • Service Providers (e.g., landscapers) who create jobs, send receipts/proof, and request or collect payment.
  • Customers who receive a receipt (often by SMS) and pay for completed work.

If you use NiceYard on behalf of a business, you represent you have authority to bind that business to these Terms.

The Service

NiceYard provides tools to (a) create and manage clients/jobs, (b) attach proof photos and receipts to a job, (c) request payment by SMS or link, (d) optionally store a payment method for future jobs, and (e) view payment history and records per job.

NiceYard is not a bank and does not hold customer funds. Payment processing is performed by regulated third‑party providers.

Payments & fees
  • Authorization. Customers authorize NiceYard and our payment partners to charge the payment method they provide for the amount shown on the receipt.
  • Receipts and records. The receipt shown to the Customer is the source of truth for what will be charged.
  • Fees. NiceYard may charge Service Providers fees for use of the Service (for example, per‑transaction fees or subscription fees). Fees, if any, will be shown in your plan or during checkout.
  • Taxes. Service Providers are responsible for determining and remitting any taxes associated with their services, unless NiceYard explicitly states otherwise.

Autopay & saved cards

Customers may choose to save a card for faster repeat payments ("Autopay"). When enabled, future jobs may be charged automatically after the proof/receipt is delivered, depending on the settings shown to the Customer at the time of opt‑in.

  • Autopay is optional unless clearly marked as required for a specific workflow.
  • Customers can disable Autopay by following instructions in their receipt/payment experience or by contacting support.
  • Saved cards are stored by our payment partners, not directly by NiceYard.

Acceptable use

You agree not to misuse the Service. For example, you will not:

  • Send payment requests for services not performed or amounts not agreed.
  • Upload unlawful content or content that infringes others' rights.
  • Attempt to interfere with the Service (e.g., probing, scraping, reverse engineering, or circumventing security).
  • Use NiceYard for prohibited industries or transactions as restricted by our payment partners.

Third‑party services

NiceYard relies on third parties for payments, SMS delivery, hosting, and analytics. Your use of those services may be subject to their terms and policies. NiceYard is not responsible for third‑party outages, delays, or errors outside our reasonable control.

Privacy & security

Our Privacy Policy explains what information we collect and how we use it. You are responsible for keeping your account secure, including safeguarding login credentials and verifying recipient phone numbers before sending payment requests.

Security note: never share sensitive card details over SMS. Card entry happens only on secure payment forms.

Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, NiceYard disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement. NiceYard does not guarantee that the Service will be uninterrupted or error‑free.

Limitation of liability

To the maximum extent permitted by law, NiceYard will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. NiceYard's total liability for claims relating to the Service will not exceed the greater of (a) fees paid to NiceYard in the 3 months before the event giving rise to the claim, or (b) $100.

Termination

You can stop using the Service at any time. NiceYard may suspend or terminate access if you violate these Terms, create risk for NiceYard or our partners, or as required by law. Some provisions (like payment obligations, limitations of liability, and dispute terms) survive termination.

Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide notice (e.g., on our website or within the Service). Continued use of NiceYard after the effective date means you accept the updated Terms.
